The lawsuit of Sarven v. Elihu Hall & Co. concerned alleged infringement of this patent, licensed to Elihu Hall & Co., on James D. Sarven's patent 17,520. Sarven prevailed because Warner's later patent used the shouldered spoke tenons as covered by Sarven's patent. As a result, Hall & Co. changed their wheel to use unshouldered tenons. Sarven sued again, and won again, but no damages were assessed because Hall had a reasonable belief that by so altering his hub he would not be infringing.E. Hall & Co. began in 1835, became E. Hall & Sons and then in 1856 became Elihu Hall & Co. |
