This patent was reissued twice, as RE8,127 and RE8,867. In the 1881 lawsuit Kells v. McKenzie and others, the inventor sued based on the expanded claims found in the reissues. The judge found that "The first four claims of reissued patent No. 8,867, to Philip H. Kells, for an improvement in brick machines, are void for the reason that they enlarge the scope of the original patent. Reissued patent No. 8,127, to Philip H. Kells, for an improvement in brick machines, is also void, because a machine embodying the invention therein claimed was 'on sale' more than two years before the application for the original patent was filed." |
