The 1871-07-22 issue of Scientific American indicated that an extension had been applied for on this patent; the "Decisions of the Commissioner of Patents for the Year 1871" notes that the extension was granted. The patent examiner's report on the extension application says, "this invention belongs to a class in which much had been done toward perfecting the operation of the machines before the application for this patent was made. In consists in an arrangement of vibrating arms connecting an external with an external gear, each carrying a feed-roll in such a manner that the distance between the rolls may be varied without disarranging the gear and interfering with its perfect action. There is no reason to doubt its novelty as claimed, or its utility." The commissioner's report says, "It appears that the applicant has failed to receive a reasonable remuneration for the time, ingenuity, and expense bestowed upon it. This was not for lack of diligence on his part, but through the failure of other parties to whom he had assigned his patent. The invention seems to be one of considerable value, and no opposition is made to its extension." We have not been able to determine who licensed his planing-machine patents, although J. A. Fay & Co. is a possibility.The inventor, Benaiah Fitts (1821-1895), was granted other patents related to planing machines, and was also granted a patent for the "Union rotary piston meter, manufactured by the Union Water Meter Company of Worcester, established in 1868 by Benaiah Fitts, Abram Fitts, and Phinehas Ball; Ball was co-inventor on the water-meter patent. Another invention, the magnetic metal-separator, was patented by Benaiah Fitts and Ezra Sawyer; Sawyer bought out Fitts' share of the invention and manufactured it himself. |
