Description: |
| The inventor applied for an extension to this patent (or, more correctly, an extension to the reissue of this patent). The patent commissioner pointed out that this invention is somewhat similar to Chamberlain's patent 10,500, and neither is inferior to the other. There are sufficient differences to merit separate patents. "It does not appear that the Draper tool-holder proper has ever been made and placed upon the market to any considerable extent. ... the first claim (of the reissue) is, to say the least, of doubtful validity. In view of Chamberlain's patent, I think it should have been more definitely limited to the precise construction shown. As it stands I believe it is calculated to mislead the public as to its just scope...."There is evidence that the main reliance for profit is upon suits for infringement of the 'principle' of construction embraced in the first claim, which would avail the inventor nothing. Twenty-five per cent of the net profits of manufacture, after deducting the expenses of extension, do not, under the circumstances of this case, promise the inventor adequate compensation." The application for extension was refused. |
