The assignee was set up to establish a cartel of harrow makers; they purchased harrow patent rights from numerous makers of harrows and then licensed them back with a proviso that the prices be fixed according to a schedule provided by the National Harrow Co. Not surprisingly, they ran into considerable legal difficulty—including no less than four lawsuits filed by National Harrow Co. against Hench & Dromgold—and they consistently were found to be an illegal restraint of trade. The National Harrow Company then reorganized as a different company, incorporated under the laws of a different state, and changed their licensing terms. It appears that this new incarnation of National Harrow Company avoided legal sanctions, but it was not a business success. |
